1. POLICY

It is the policy of the Ridgely Police Department to enforce all Executive Orders issued by Governor Lawrence J. Hogan, Jr., pursuant to his authority under Title, 14, Subtitle 3, of the Public Safety Article of the Maryland Annotated Code to declare a State of Emergency, and under Title 14, Subtitle 3A, to declare a catastrophic health emergency, in response to the COVID-19 pandemic, where such Executive Orders provide for enforcement by local law enforcement officers and where violation of such orders may result in criminal charges and penalties.

2. ENFORCEMENT OF EXECUTIVE ORDERS

A. If a Ridgely Police Officer is requested to respond to or encounters a situation that violates an Executive Order that provides for enforcement by local law enforcement authorities and for criminal penalties, he shall determine if there is probable cause to believe that a violation of the Executive Order has occurred.

1. If the Officer determines that he has probable cause to believe that a violation of the Executive Order has occurred, he shall:

2. a) Explain the Executive Order to the person in violation, the acts prohibited by the Executive Order, and the possible penalties for violations; and

b) Advise the person of the conduct that violates the Executive Order and the need to comply to protect public health, safety, and welfare, and to avoid possible criminal penalties.

B. Voluntary compliance should be obtained whenever possible. If voluntary compliance is not obtained:

1. Advise the person that a violation of an Executive Order is punishable as a misdemeanor under section 14-309 of the Public Safety Article, which provides for a sentence of not more than six months imprisonment and a fine of not more than $1,000; or for a catastrophic health emergency under section 14- 3a-08, where a violation of an Executive Order is punishable as a misdemeanor subject to imprisonment not exceeding 1 year or a fine not exceeding $ 5,000 or both.

2. Advise the person that he may be arrested for failing to comply with the Executive Order. a) If the person continues to fail to comply, officers should consult with the Chief of Police or Sergeant to determine if an on-scene arrest should be made or a criminal summons would be obtained at a later time.

3. POLICY REVIEW This Special Order is subject to review and amendment as Executive Orders are issued, revised, or rescinded by the Governor.
