Ref: Special Order 20-04 GOVERNOR EXECUTIVE ORDER – “FACE COVERING EXECUTIVE ORDER ENFORCEMENT” CLARIFICATION

I. PURPOSE

1. Effective 0700hrs on April 18, 2020, until further notice and in accordance with Governor Hogan’s Executive Order Number 20-04-15-01, face coverings shall be worn by persons having any contact with others while in a retail establishment, foodservice establishment, or on public transportation. “Face covering” means a covering that fully covers a person’s nose and mouth and includes scarves and bandanas.

II. SCOPE 1. As with all Executive Order enforcement, education and voluntary compliance are the main objective.

IV. MANDATED REQUIREMENTS

1. Face Coverings are required by:

A. Riders and operators of any public transportation.

B. All customers aged nine (9) and over while in any retail establishment or food service establishment. Adults shall make reasonable efforts to have children aged two (2) through nine (9) wear a face covering.

C. Staff members of retail establishments while working in areas open to the general public or areas where they will likely interact with other staff members. D. Food service workers who interact with customers including delivery persons.

V. PROCEDURE

1. Ridgely Police Department Officers will wear an approved face covering, if it becomes necessary to enter any business.

2. Ridgely Police Department Officers will approach the person in an attempt to gain voluntary compliance. Advise the person of the Executive Order and the need for wearing a face covering for public health safety reasons. If the person complies by either putting on a face cover or leaving the business, no further action is necessary.

3. If the person refuses to comply, and if the business representative confirms with the officer that the business does not want the person on their premises without a face cover, the Ridgely Police Department Officer will inform the person that the business is requesting them to leave. If at this point, the person refuses to put on a face cover, or leave the business, the Officer should handle this the same way they would handle any other trespassing incident. Any enforcement action will be done in consultation with the local state’s attorney’s office. If a Criminal Citation is used to charge the person, the normal processing requirements have been temporarily suspended. Ridgely Police Department Officers will indicate in the Criminal Investigation Report that fingerprints and photographs were not taken due to the COVID-19 pandemic and will request court ordered fingerprinting upon a finding of guilt.

4. If the person refuses to comply, and if the business representative informs the Officer that they are not requiring customers or employees to wear face coverings, the Officer will inform the business representative of the 3 requirements of the Governor’s Order. If the business still refuses to comply, the Ridgely Police Department Officer will inform them that the incident will be documented as a refusal and reported to the local health department. The noncompliance will be documented on an Incident Report and promptly provided to the local health department via the Chief of Police for the Ridgely Police Department.

VI. POLICY REVIEW

1. This Special Order is subject to review and amendment as Executive Orders are issued, revised, or rescinded by the Governor.
